Abstract

Crimes in the land sector may include criminal acts and violations in the creation of physical and juridical data, such as the destruction of land boundary markers and their relocation, the provision of false data related to land ownership, and the fabrication of fake documents such as Land Certificate Statements or Compensation Statements involving several parties such as village heads, subdistrict heads, district heads, and applicants for land rights. The main issues in this research are: How is the impementation of law enforcement against perpetrators of forgery of property certificates at the ATR/BPN Office in Pekanbaru City? What are the obstacles in implementing law enforcement against the perpetrators of forgery of property certificates at the ATR/BPN Office in Pekanbaru City? This study uses a sociological legal research method. The data is analyzed qualitatively, meaning it is not processed using statistics, mathematics, or similar methods. The data obtained in this study is presented in a qualitative manner. The approaches used in the data analysis are the statute approach (based on legal rules), the conceptual approach (based on legal concepts or theories), and the analytical approach (conceptual analysis of statutory regulations). The implementation of law enforcement regarding accountability for the loss of land title deed documents at the ATR/BPN Office in Pekanbaru City indicates that such losses are a serious issue that impacts legal certainty and land ownership rights. In enforcing accountability, there are administrative mechanisms that allow for document replacement, as well as sanctions for negligent employees. However, in terms of criminal law, proving elements of intent or abuse of authority is often challenging. The obstacles in implementing law enforcement for the loss of land title deed documents include weak document management systems, lack of coordination between institutions, and limited public understanding of the legal procedures that must be followed. In addition, lengthy bureaucracy and suboptimal digitization of archives are also factors that slow down the resolution of cases.
