Abstract

Restorative Justice approach at the Kuantan Singingi Police Resort. The choice of this title is based on the mechanism for resolving criminal cases of traffic accidents according to the traffic and road transportation law, if it has fulfilled the elements of a crime, a legal process must be carried out in accordance with the criminal justice system which includes: investigation, action, examination and settlement and submission of cases. In practice, a number of traffic accident cases are seen that are not resolved through the courts but are resolved peacefully by the parties. This study aims to determine how Restorative Justice is applied in resolving traffic accident cases that cause serious injuries to victims at the Kuantan Singingi Police Resort, what are the obstacles to the success and failure of the application of Restorative Justice in resolving traffic accident cases that cause serious injuries to victims in the jurisdiction of the Kuantan Singingi Police Resort. This type of research is sociological legal research, namely research by means of a survey, the type of data used in this study comes from primary data and secondary data, primary data is obtained from the results of field research while secondary data is obtained from the results of library research. The nature of this research is descriptive, namely research conducted by conducting interviews with several respondents, namely the Head of Traffic Police of Kuantan Singingi, Head of Traffic Accident Unit, victims, perpetrators' families, victims and community leaders, data analysis used in this study is qualitative data analysis. From the results obtained by the author, the application of Restorative Justice was resolved in a family manner by involving the parties involved starting from the perpetrator, victim, perpetrator's parents, victim's party, and community leaders, the agreement obtained from the results of the peace was stated in a peace agreement signed by the parties in resolving it by means of mediation, while the obstacles to the success and failure of the application of Restorative Justice are the difficulty of achieving an agreement between the perpetrator and victim and the intervention of a third party during the peace process.
