Abstract
One of the rights of children who commit criminal acts of theft is to get diversion. Diversion is the diversion of the settlement of child crime cases from the criminal justice system to processes outside the criminal justice system. These guidelines apply to children who are 12 years old but under 18 years old, or 12 year olds even though they are married but under 18 years old, who are sentenced to imprisonment for less than 7 years, and do not repeat the crime. The implementation of diversion against children in the stage of examining the crime of theft at the Pelalawan District Court aims to find out how the application of diversion is carried out against children who commit the crime of theft and what are the obstacles in applying diversion to children at the examination stage at the Pelalawan District Court. This type of research is sociological legal research, namely research to obtain primary and secondary data. This research is descriptive in nature, describing the application of diversion in the examination stage and the obstacles faced at the Pelalawan District Court. Data collection techniques by interviewing several respondents, namely: Child Judge, and young clerk. Based on the research obtained by the author, the implementation of the diversion of the crime of theft committed by children at the examination Stage at the Pelalawan District Court is in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which involves victims, perpetrators, parents of victims and perpetrators to the Correctional Center. . The obstacles faced by judges at the Pelalawan District Court in implementing this diversion were victims who did not want to forgive the perpetrators, lack of public understanding of diversion, and lack of transportation, facilities and infrastructure to carry out this diversion.
