Abstract

Abortion is the abortion of the fetus in the womb, this effort is one of the fastest ways to get rid of the fetus. With this being an interesting phenomenon in social circles, even this is also very dangerous to do. According to fiqh experts, the meaning contained in the fall of a womb is something that throws away, and gives birth in a dead state. From a medical point of view, abortion is also forced expulsion of the fetus regardless of gestational age, causing death. The main problem in this study is what are the factors causing the crime of abortion provocatus criminalis in the jurisdiction of the Tenayan Raya Police and what is the juridical review of the crime of abortion provocatus criminalis in the jurisdiction of the Tenayan Raya Police. This research was conducted using normative legal research which is descriptive in nature which contains research based on literature studies by looking at materials originating from the literature and describing things that happened by looking at the circumstances according to the facts, and has limitations in this study with the results of a decision by judge in case Number: 612/Pid.Sus/2018/PN Pbr. Based on the results of the research, it is understood that there are several factors that cause the criminal act of abortion to be committed by someone including economic factors, social factors, educational factors, technological development factors, pregnant out of wedlock, not ready to have a family and have children, betrayal or coercion factors from the man who got pregnant, as well as the consideration factors of the man who got him pregnant. The efforts made by the Government to prevent the occurrence of the crime of abortion committed by students are pursued through pre-emptive, preventive and repressive efforts.
