Abstract

Village regulations (PerDes) are a form of legislation formed in the framework of administering village government. The function of PerDes is to limit power, regulate the life of village communities in order to achieve the goals of the Indonesian State. Even though the PerDes function is very important, in its implementation the formation of PerDes in Jake's village does not yet exist at all, even though in terms of regulation the Village Consultative Body (BPD) of Jake's village has the authority to discuss draft village regulations contained in more specific regulations, namely the Kuantan Singingi Regency Regional Regulation Number 1of 2019 concerning the Village Consultative Body (Perda No. 1 of 2009) which mandates establishing a draft Village Regulation with the Village Head, accommodating and channeling community aspirations. The problem in this research is how the function of the Village Consultative Body based on Regional Regulation No. 1 of 2009 concerning the Jake Village Consultative Body, Kuantan Tengah District, Kuantan Singingi Regency in making Village Regulations and What are the obstacles to BPD Jake, Kuantan Tengah District, Kuantan Singingi Regency in making Village Regulations. The method in this research is sociological legal research, namely explaining and describing the realities in the field very thoroughly. The results of the study show that the Jake Village Consultative Body is based on the Regional Regulation of Kuantan Singing Regency Number 1 of 2009 concerning the Village Consultative Assembly has the function of establishing Village Regulations with the Village Head, accommodating and channeling community aspirations through the process of formulating and establishing Draft Village Regulations with the Village Government. But until now there is not a single PerDes in Jake's Village. Meanwhile, the neighboring village has Logas Hilir Village Regulation Number 5 of 2021 concerning Gender Responsive Village Development in the Small-Scale Gold Mining Sector in Logas Hilir Village, Singingi District, Kuantan Singingi Regency. There are obstacles faced by the Jake Village Consultative Body when carrying out its functions at every stage of forming village regulations, such as in terms of accommodating as well as channeling community aspirations. This happened because there were still several factors that became obstacles to implementing the functions of the Jake Village Consultative Body in making village regulations including, firstly internal factors such as inadequate human resources and secondly external factors such as passive society, lack of understanding of legal culture, and poor communication. not well tied.
