Abstract
ABSTRACT In this study, more emphasis is placed on the application of restorative justice to the settlement of traffic accidents that are resolved out of court by minors in the jurisdiction of the Dumai Police in 2021, where restorative justice is still a new thing in the criminal justice system and has never been researched regarding application of restorative justice criminal acts of traffic accidents committed by minors which resulted in serious injuries to victims, especially in the jurisdiction of the Dumai Police. The main problem in this research is how to apply restorative justice to traffic accident crimes committed by children in the jurisdiction of the Dumai Police, and what are the obstacles in applying restorative justice to traffic accident crimes committed by children in the jurisdiction of the Dumai Police. The research carried out was empirical legal research using observation research or field surveys by direct surveys to the field, to collect primary and secondary data obtained from respondents both through interviews and the results of library research to be used as data or information as material in writing this research. Based on the results of the research, it can be understood that the application of restorative justice to traffic accident crimes committed by children in the jurisdiction of the Dumai Police is carried out based on Article 1 number 7 of Law No. 11 of 2012 concerning Juvenile Justice, in which cases are resolved outside the court by means of diversion. namely calling the parties involved and then involving community leaders such as RT/RW and making peace letters.
