Abstract

The departure of prospective Umrah pilgrims requires an agreement. The agreement can be made with tour and travel companies. The relationship between the prospective Umrah pilgrims and the Tour and Travel company is preceded by an agreement between the parties, which contains the terms, rights and obligations of the parties in the agreement. In the case of a cancellation that occurs as a result of the closure of entry access by the State of Saudi Arabia due to preventing the spread of the Covid-19 virus, it cannot be said to be a cancellation of the agreement or default. This is because the Covid-19 pandemic may end one day. The main problem in this research is how to implement legal protection for users of Umrah travel bureaus due to the cancellation of the departure of prospective pilgrims during the Covid-19 pandemic and how to settle accountability for canceling the departure of prospective Umrah pilgrims at PT. Kebaitullah's Sacred Intentions during the Covid-19 pandemic. The research method used is Sociology of Law, namely by means of surveys, namely researchers directly conducting research on location. However, in terms of the nature of this research, this research is descriptive in nature, namely explaining and describing the facts in the field that have been studied regarding legal protection against cancellation of prospective Umrah pilgrims' departure at PT. The Sacred Intention of Kebaitullah Caused by the Covid-19 Pandemic. In the results of research conducted by the author, Covid-19, which is included in a force majeure situation, makes the rights and obligations of consumers and service providers unfulfilled. But in this compelling situation all consumer rights that are not fulfilled by service providers cannot be asked for compensation in accordance with Article 1245 of the Civil Code, but service providers continue to carry out their responsibilities such as providing correct and clear information. Therefore even if the consumer's rights are not fulfilled, the service provider is fully responsible for what happens as a result of this force majeure. This is done in order to achieve the interests of all parties in order to achieve legal objectives, namely justice, benefit and legal certainty. Settlement carried out by PT. The sacred intention of Kebaitullah regarding the problems experienced by its congregation is carried out by deliberation among the consumers or pilgrims who will depart, to accept that the implementation of their departure has been postponed according to the next scheduled departure.
