Abstract
With the convenience offered by the internet, it is only natural that conventional buying and selling transactions are being abandoned. Currently, transactions via the internet are preferred because of the convenience they offer. Trade transactions through electronic systems, especially the internet, promise a number of advantages, but at the same time they also have the potential for a number of losses. The development of internet technology has created new problems in the field of law, especially consumer protection law. With trading via the internet, virtual business systems are also developing, such as virtual stores and virtual companies. Business people run their business and trade through internet media and no longer rely on real, conventional business companies. The formulation of the problem in this study is, first, how is legal protection for consumers in the event of default in buying and selling online through Instagram media in Pekanbaru City. Second, what are the legal remedies taken by consumers in the event of default in buying and selling online through Instagram media in Pekanbaru City. The type of research that the authors use in this research is empirical sociological research by going directly to the field to obtain some data (Observational Research). library search process. The data collection techniques that the authors use are interviews and questionnaires. While the method of drawing conclusions that the author uses in this study is the deductive method of drawing conclusions, namely drawing conclusions from things that are general to specific. The results of the research and discussion that the authors found are that a form of legal protection for consumers is the settlement of consumer disputes, the process of resolving consumer disputes is carried out if in online transactions there is a violation of consumer rights. Legal remedies that can be taken by consumers who suffer losses can be carried out through the court or outside the court, this provision is regulated in Law Number 8 of 1999 concerning Consumer Protection. The legal process which is quite long and time-consuming is sometimes the main obstacle for consumers to make claims for the losses they experience by shopping on online shopping sites or applications. So that most consumers prefer to ignore these problems without any solutions and of course this will ultimately harm the consumers themselves. There is a response in the community that in shopping online, consumers must be prepared to bear the consequences if the product does not match what is offered and expected by consumers, is also one of the obstacles in implementing legal protection for consumers in online buying and selling transactions.
