Abstract

Hadhanah is an obligation for both parents when they are still in a marital relationship or after a divorce. Child rearing or hadhanah is an activity of raising, nurturing and educating children until they are adults or able to stand on their own. Fulfillment of children's rights is an activity to guarantee needs, protect and provide what children should get such as the right to live, grow and develop, to be cared for and cared for by their own parents. Not fulfilling hadhanah for children can have a big impact on the child's life in the future. This study discusses the Juridical Review of the Fulfillment of the Child's Hadhanah Rights after Divorce which aims to find out whether when a divorce occurs the hadhanah obligation is carried out properly or not in the jurisdiction of the Ujung Tanjung Religious Court, and also wants to know what legal protection and legal consequences are if the hadhanah obligation is not implemented. This research is a type of empirical legal research, which is also called field research. The nature of the research used is the nature of qualitative research. This research was conducted in the jurisdiction of the Ujung Tanjung Religious Court, Rokan Hilir Regency. The data source used is the primary data source obtained by conducting interviews and questionnaires. Secondary data that explains the theoretical basis in this study such as the Compilation of Islamic Law and Law Number 1 of 1974 concerning Marriage. Based on the research that has been conducted by the author, it is found that the fulfillment of the hadhanah rights of children has not been fully fulfilled, apart from being caused by the divorce factor it is also due to a lack of awareness and high ego of each party in terms of carrying out their obligations. Even though the Compilation of Islamic Law and Law Number 1 of 1974 contains an obligation for parents to look after their children even though they are not in a marital relationship.
