Abstract

Public transportation is indispensable for development or commerce issues. But in reality, transport drivers still often take actions that are considered to cause harm to passengers. With the enactment of Law no. 8 of 1999 concerning Consumer Protection is expected to be able to help create legal certainty for parties related to the operation of transportation services, be it transport operators, workers (drivers/drivers) and passengers. This thesis is the legal position of public transport service users (passengers) as consumers of public transportation facilities, things that can cause harm to public transport service users (passengers) in the operation of transportation, and the form of legal protection provided by Law no. 8 of 1999 to service users (consumers) of public transport. The purpose of this research is to find out the implementation and accountability of the Pekanbaru busway transportation service provider if an accident occurs while using the busway and what legal remedies can be taken by the consumer as legal protection for the losses that have been experienced by consumers. The writing method that underlies the writing of this thesis is an empirical research method in which the author will conduct a direct reduction research on the ability to supervise one of the transportation companies in the city of Pekanbaru, namely the transportation company PT TPM Transportasi Pekanbaru Madani and also interview busway consumers. The conclusion of this study is that PT TransPortasi Pekanbaru Madani's responsibilities for busway services start from transporting consumers from the starting place to the destination that has been agreed upon by both parties, as well as legal protection for service users (passengers) of public transportation which has been properly regulated in Law no. 8 of 1999 concerning consumer protection, in which this law contains not only the roles and responsibilities of carriers and passengers but also regulations regarding the roles and responsibilities of government and society, as well as sanctions for parties who do not comply with the regulations contained in the law.
