Abstract

This study aims to determine the legal provisions regarding bank secrecy based on Law Number 10 of 1998 concerning Banking and to determine the form of legal protection for customers at the Indra Arta Rengat People's Credit Bank (BPR) related to bank secrecy. The main problem in this research is how is legal protection for bank secret security in protecting customer interests at Indra Arta Rengat Rural Banks (BPR)? and What are the Factors Causing Bank Secrecy Violations at the Indra Arta Rengat People's Credit Bank (BPR)? The method used in this thesis is empirical legal research, namely with facts taken from human behavior, obtained from interviews and real behavior carried out through direct observation. Legal protection for customers as consumers in the banking sector is very important, due to the fact that the positions of business actors and consumers in this case are banks and customers are often unequal. Agreements when customers will use bank services that should be made based on the agreement of both parties become agreements only made by parties who have a higher position, namely the bank. Direct legal protection by the banking world for the interests of customers depositing funds is a protection provided to customers saving funds directly against the possibility of risk of loss arising from the business activities carried out by the bank. The responsibility of the bank if the customer suffers a loss is to handle and resolve various customer complaints and complaints, to avoid protracted problems that occur. Customer complaints are carried out with a standard time that is determined and generally applies. The risks contained in bank credit agreements can be seen from two sides, namely the risks borne by the bank as a creditor and the risks borne by the debtor customer.
