Abstract

Sharia principles are the rules of agreement based on sharia law between banks and other parties to save funds and finance business activities that are declared in accordance with sharia. Sharia principles must be appropriate in the murabaha financing process. The definition of murabahah financing is a form of financing with the principle of buying and selling goods at the original price with an additional profit agreed with the bank as the seller and the customer as the buyer. The main problem in this study is the implementation of sharia principles in the management of murabahah financing applied at BTN Syariah Pekanbaru Branch and the consistency of applying sharia principles to murabahah financing at BTN Syariah Pekanbaru Branch. The research carried out is an empirical legal research method using observation research or field surveys by way of direct surveys to the field, to collect primary and secondary data obtained from respondents both through questionnaires and interviews to be used as data or information as material in writing this research. Based on the results of the study, it can be understood that the implementation of sharia principles in the processing of murabahah financing at Bank BTN is not in accordance with the requirements of murabaha financing because it does not meet sharia principles in the form of usury, gharar and zalim. In this case, the object or goods traded on murabahah financing at BTN Syariah Pekanbaru Branch contains an element of gharar, where the goods that are the object of the agreement are not clearly and in detail the amount and specifications. Meanwhile, in the process of applying sharia principles to murabahah financing in general, it has fulfilled the provisions of sharia law, both the terms and the pillars of murabahah financing.
