Abstract
ABSTRACT In Law Number 13 of 2003, Outsourcing is regulated in Article 64, which reads as follows: "Companies can hand over part of the work to other companies through a written work contract agreement." The company can give part of the execution of the work to other companies through a work charter agreement or worker or labor service provider made in writing. So that the Labor Law explains that the outsourcing system can be implemented in 2 ways, namely by entering into a work charter agreement or worker or labor service provider. Both agreements are referred to as outsourcing agreements. This research focuses on what are the constraints of Outsourcing Company Responsibility towards Workers who die as a result of work accidents in terms of Law Number 13 of 2003 concerning Employment (Case Study at PT. Andesta Mandiri Utama) and Outsourcing Corporate Responsibility towards Workers who die world due to work accidents in terms of Law Number 13 of 2003 concerning Employment (Case Study at PT. Andesta Mandiri Utama). Judging from its nature, this research is descriptive research (descriptive research). To describe this research, the type of research that will be used by researchers is empirical research, because researchers will directly conduct research at the research location. By examining directly to the research location, researchers can find out the data analysis that will be used as a research. the author uses the method, Interview, which is carried out by holding direct interviews with respondents as resource persons. Constraints Lack of understanding of the Company. PT. Andesta Mandiri Utama Mitra Employment BPJS in the process at PT. Andesta Mandiri Utama asked BPJS Ketenagakerjaan to quickly take action against its employees who wish to submit claims for accident insurance and death benefits, PT. In this case, Andesta Mandiri Utama, through its treasurer, is often late in preparing data for accident and death insurance. Efforts in Outsourcing Corporate Responsibility for Workers who die as a result of work accidents in terms of Law Number 13 of 2003 concerning Employment (Case Study at PT. Andesta Mandiri Utama), increase the understanding of the company PT. Andesta Mandiri Utama in providing compensation to workers who died, providing death benefits as a supplement to old age benefits, both of which are guarantees for the future of workers, Fulfilling the rights of outsourced workers or legal protection of outsourced workers is the responsibility of the company receiving the work (PT. Andesta Mandiri Utama).
