Abstract

The use of PayLater services has a negative impact because of the easy access to the internet at this time, many third parties or irresponsible parties. where there are parties who commit personal data theft, intimidation for late payments, dissemination of consumer personal data, and others related to consumer personal data. Which causes many consumers to get PayLater bills that are not in accordance with the initial agreement. The main problem of this research is How is Consumer Legal Protection in Using Traveloka Paylater? And what are the legal remedies against losses in using Traveloka Paylater? The research method used in this study is to use Sociological Law research, with data collection techniques namely interviews. Judging from the nature of this research, it is a descriptive research, namely research that provides a clear and detailed description of the main research issues. The results of the discussion of this study are Consumer Legal Protection in Using Paylater as a legal umbrella for legal protection regulated in Article 1338 of the Civil Code, Law Number 19 of 2016 concerning Information and Electronic Transactions and Law Number 8 of 1999 in conjunction with POJK Number 13/POJK. 02/2018, where all agreements made legally apply as laws for those who make them. Legal protection for consumers that can be carried out before (preventive legal protection) transactions occur, as stipulated in the provisions of article 4 jo. Article 62 of Law Number 8 of 1999 concerning Consumer Protection and OJK Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Borrowing and Borrowing Services. The form of protection provided by the Traveloka paylater is in the form of a complaint system that can be applied as an effort to ensure the safety, convenience of Traveloka consumers and Efforts to resolve disputes can be carried out through legal remedies in litigation by carrying out lawsuits in unlawful acts and other than through lawsuits can be through non-legal remedies. litigation such as mediation, negotiation, deliberative arbitration. Efforts to resolve disputes provided by Traveloka, disputes can be done by way of deliberation, if there is no agreement, it can be continued with mediation.
