Abstract

This research aims to analyze the legal protection for consumers in cases of breach of contract (wanprestasi) in e-commerce transactions, particularly on the Shopee platform, based on Law Number 8 of 1999 concerning Consumer Protection. The background of this study stems from the increasing number of problems faced by consumers in online transactions, especially those related to breaches of contract such as delayed delivery, goods not matching the order, or items not being delivered at all. This phenomenon creates legal uncertainty for consumers, as the legal protection provided is often inadequate. Furthermore, although regulations governing consumer rights exist, their implementation in practice still encounters numerous obstacles. The main issues discussed in this study are the effectiveness of the implementation of Law Number 8 of 1999 in protecting consumers from breach of contract in e-commerce transactions, and the common forms of breach of contract in e-commerce along with their impact on consumer rights in Indonesia. The purpose of this research is to examine the effectiveness of consumer protection regulations and identify the various types of breach of contract that occur, as well as their implications for consumer rights. This legal research is classified as empirical sociological legal research. This method is intended to solve current issues by collecting data, organizing and classifying it, and then analyzing and observing the legal reality in society in order to draw conclusions. The results of the study show that legal protection for consumers on Shopee is still not optimal. Although Law Number 8 of 1999 outlines consumer rights, its implementation in dispute resolution and refund processes still faces various challenges. Common forms of breach include delayed delivery, defective products, and undelivered items. This study recommends enhanced supervision of business actors and improvements to dispute resolution mechanisms to ensure better protection for consumers.
