Abstract

he rights of children in polygamous families in positive law are: a) civil rights; b) the right to protection; c) the right to education and care; d) the right of children to welfare; e) the right of children to have their legal affairs taken care of. The perspective of positive law and Islamic law on violations of the rights of children in polygamy is that parents who violate the rights of children in polygamous families can have their parental authority revoked for their children. In the perspective of Islamic law, violations of the rights of children in polygamy are subject to moral and legal sanctions. These legal sanctions are a form of worldly punishment for perpetrators of violations of children's rights. The main problem in this study is how to protect children in polygamous families legally in Siak Regency, obstacles in implementing legal protection for children in polygamous families in Siak Regency, and efforts to overcome obstacles that occur in polygamous families in Siak Regency. The research method used by the researcher in this study is the sociological legal research method, seen from its type, it is carried out by means of observation (observational research) by means of a survey, meaning a study conducted by the author by going directly to the field to obtain information and data related to the author's research. The results of the study indicate that the ease of polygamous marriages occurs because of the husband's hidden will (marriage under hand) and or infidelity, by means of manipulation of administrative data and obscuring marital status so that such marriages do not have permanent legal force (legal) and are full of easy cracks in the household which leads to the insecurity of the existence of life and development of the children of the polygamous family itself. Which is some of the obstacles in the implementation of legal protection for children in polygamous families in Siak Sri Indrapura Regency are caused by several factors of hidden polygamous marriages (infidelity), the husband's income factor that is not sufficient for both physical and spiritual needs, and the emergence of disharmony and harmony between children in polygamous families. So that the implementation of legal protection for children of polygamous families in Siak Sri Indrapura Regency has not been achieved properly, because polygamous marriages are motivated by hidden marriages (infidelity) only because of desire and lust alone in a way that is not justified by law, so that it is full of the failure to maintain the integrity and harmony of the polygamous family which leads to the threat to the survival of children of polygamous families.
