Abstract

Since humans were born, they have interacted with other humans in a setting we know as society. The process of development can bring progress to society, but it can also cause changes in social conditions that have negative social impacts, particularly with regard to the increase in criminal acts that disturb society. One of the most notable criminal acts is corruption. Corruption is a crime with extraordinary consequences, so its handling is also extraordinary, requiring special measures through specific criminal laws. This type of research falls under the category of normative legal research, which involves analyzing books, scientific works, and legal regulations that cover legal principles, legal systems, and other related topics. The results of the research on the application of criminal law to corruption crimes related to the procurement of science laboratory equipment for elementary schools based on competency in Kuantan Singingi District were investigated by the Kuantan Singingi District Prosecutor's Office in 2022. The investigators first calculated the state losses by the Kuantan Singingi District Inspectorate No. 07/LHATT/ITKAB/2022 dated May 17, 2022, which amounted to Rp1,303,120,270.00 (one billion three hundred three million one hundred twenty thousand two hundred seventy rupiah). And the evidence from witnesses and experts. In the indictment, the public prosecutor used primary and subsidiary charges against the defendants Aries Susanto, S.Hut., Ledy Oktora, S.Km., and Sartian, S.T. In this case, the three defendants have separate case files due to their different roles, with defendant Sartian acting as the PPK, Ledy Oktora as the winning bidder/party in the procurement activity, and Aries Susanto as the person who carried out the work by borrowing Ledy Oktora's company. Based on these circumstances, the prosecutor sought a sentence of 3 years and 6 months for defendant Sartian and 9 years and 6 months for defendant Aries Susanto. The court's considerations in sentencing for the corruption case involving the procurement of competency-based science laboratory equipment for elementary schools in Kuantan Singingi District In its considerations, the court must base its decision on the prosecutor's charges, the legal facts obtained during the trial, With the implementation of the procurement of science laboratory equipment for elementary schools based on competency at the Education, Youth, and Sports Office of Kuantan Singingi District for the 2018 fiscal year, the defendant Aries Susanto, S.Hut, on behalf of CV. ELOK JUO as the Service Provider, and the receipt of 100% payment amounting to Rp.4,370,060,200.00, there was an overpayment resulting from price inflation/mark-up in the preparation of the estimated price, which benefited the defendants. Therefore, the court rendered a verdict against the defendant SARTIAN, ST, M.Si, and Ledi to two years' imprisonment and a fine of Rp. 50,000,000.00, with the condition that if the fine is not paid, it will be replaced with two months' imprisonment; The defendant is ordered to pay court costs of Rp 7,500.00. The court sentenced the defendant Aries Susanto, S.Hut, to imprisonment for 6 years and 6 months and a fine of Rp 50,000,000.00 (fifty million rupiah), with the provision that if the fine is not paid, it shall be replaced with imprisonment for 2 months; The defendant is ordered to pay compensation in the amount of Rp 1,227,120,270.00 and is ordered to pay court costs in the amount of Rp 7,500.00 (seven thousand five hundred rupiah);
