Abstract
The development of the food industry in Indonesia presents various types of food products that are consumed by the public every day, including yellow noodles. However, along with the high demand for food products, various problems related to food safety have also emerged, one of which is the use of hazardous materials in the production process. The case of yellow noodles containing hazardous materials is a real example where business actors ignore their obligations to consumers, by continuing to use hazardous chemicals that violate health standards, namely formalin. Based on several media reports and investigation results from related agencies, a number of traders in the traditional market still use hazardous substances such as formalin in the production process or preservation of yellow noodles to make them look more attractive and last longer. Law Number 8 of 1999 provides a legal basis for consumer protection from products that have the potential to endanger health. In the context of yellow noodles containing hazardous materials, there are responsibilities that must be fulfilled by business actors to ensure that the products they sell are safe and meet health standards. The problems in this study are: First, What is the responsibility of business actors to consumers regarding yellow noodles containing hazardous materials. Second, What are the legal consequences of business actors who harm consumers regarding yellow noodles containing hazardous materials based on Law Number 8 of 1999 concerning Consumer Protection. The legal research conducted is empirical sociological legal research, namely research that focuses on the behavior of the legal community (law in action) which uses primary data as its main data, namely data obtained directly from respondents, namely subjects who provide answers to researcher questions in an interview that is directly related to the legal problem to be studied. The results of this study conclude that: First, the responsibility of business actors to consumers related to yellow noodles containing hazardous materials in Pasar Bawah Pekanbaru cannot be accounted for, because they are not the main producers who produce the wet noodles. In this case, their position is more similar to consumers, because they only resell the product, not for personal consumption. This violates Article 19 of Law Number 8 of 1999 concerning Consumer Protection, which regulates product liability. Product liability is the legal responsibility of individuals or bodies that produce or distribute products. The legal consequences for business actors who harm consumers related to yellow noodles containing hazardous materials according to Law Number 8 of 1999 concerning Consumer Protection for the product include civil liability, in the form of a refund, replacement of goods with similar goods or goods of equivalent value, or provision of health care and/or compensation if the product causes adverse effects on consumer health. xiii In addition, there are administrative sanctions including written warnings, revocation of business licenses, prohibitions on distributing goods, and withdrawal of goods from circulation. On the other hand, business actors can also be subject to criminal sanctions in the form of a maximum prison sentence of 5 years, or a maximum fine of IDR 2 billion.
