Abstract

This research is entitled The Juridical Analysis of The Impact of Underage Marriage Based on Law Number 1 Year 1974 against The Amendment to Law Number 16 Year 2019 Regarding Marriage in Kabupaten Kuantan Singingi, Kecamatan Kuantan Tengah. The purpose of this research is to investigate and comprehend the factors that cause underage marriages and their impact on the social and legal life of the local community. This research uses empirical and sociological approaches, with the research location in Teluk Kuantan, Kabupaten Kuantan Singingi, Kecamatan Kuantan Tengah. The results show that five main factors caused underage marriage are: the lack of awareness of the law, the weak role of law enforcement, the legal culture of society, pregnancy out of wedlock, and economic pressure. These factors have weakened the authority of Kantor Urusan Agama (the Religious Affairs Office) in assessing the legality of underage marriages, leading to the continuance of this practice. From this research, it can be concluded that many underage marriages in Kabupaten Kuantan Singingi, Kecamatan Kuantan Tengah, are not under the applicable laws and regulations. Although underage marriages can only legally be conducted with dispensation from the Religious Court, the reality shows that many are performed without such a process, even involving the manipulation of age data by certain individuals to expedite the administrative process. This shows the necessity of increasing law awareness, stricter supervision, and consistent law enforcement to protect children's rights and ensure legal certainty.
