Abstract
Consumer protection is an effort to ensure legal certainty in protecting consumer rights. Law Number 8 of 1999 concerning Consumer Protection aims to establish a protection system that guarantees legal certainty, openness, and access to correct information. The law also explains the definition of a consumer, namely "every person who uses goods and/or services who is willing in society, either for the benefit of themselves, their families, other people, or other living things and not for trading". The formulation of the problem in this thesis research is: first, what is the form of legal protection for consumers who suffer losses due to goods that are not in accordance with the clothing sale and purchase agreement through the Facebook application, second, what are the obstacles in obtaining legal protection for consumers in clothing sale and purchase agreements through the Facebook application in Kubu District. This study focuses on the form of legal protection for consumers who experience losses due to the purchase of clothing through the Facebook application in Kubu District, as well as the obstacles faced in obtaining such legal protection. This study uses an empirical approach with a data collection method by distributing questionnaires to consumers who make online clothing transactions in the area. The results of the study indicate that the implementation of consumer protection has not been running effectively as regulated in the laws and regulations. Consumers stated that they did not receive adequate legal protection because business actors often did not take responsibility for the losses incurred. The obstacles in the implementation of this legal protection are the occurrence of default by business actors, business actors do not have good intentions to compensate consumers for losses, low consumer knowledge, consumers who are less concerned, and finally the long return application process.
