Abstract

In terms of law enforcement in the Republic of Indonesia, it is not only the Police, Judges, and Prosecutors, but also Advocates who play a very important role. The role of Advocates in law enforcement in this country is significant, as Advocates have the authority and ability to enter legal areas, such as: Civil Law, Criminal Law, State Administrative Law, both litigation and non-litigation in other civil matters. An Advocate is a profession that provides legal assistance, carrying out duties and functions by acting as a companion, legal advisor, or even a legal power of attorney for individuals and/or legal entities. Based on this, the author conducted this research with the aim of knowing how the role of Advocates in handling Corruption Crimes, the responsibilities of Advocates in handling Corruption Crimes, and to find out the obstacles faced by Advocates in dealing with corruption cases. This research uses a sociological, juridical, and empirical approach, where the researcher directly goes into the field. Data collection techniques used are through field research and literature study, including primary and secondary data and supported by data from criminal cases in court. The role and tasks of Advocates in handling corruption cases are explained in Law Number 18 of 2003, where an Advocate is a free and independent profession, responsible for law enforcement, equal to other law enforcement agencies such as the Police and the Attorney General's Office. Advocates are placed in a position to safeguard and represent justice in the legal system in the interest of society. Therefore, this authority is very important in maintaining the independence of law enforcement to run its profession according to the Advocate's Code of Ethics. In carrying out their profession, Advocates face various obstacles when clients need legal aid services. These include clients not understanding or studying the law, giving consent without fully understanding the agreement, potential harm due to one-sided agreements, clients' dishonesty, lack of transparency from clients in providing information, lack of trust, clients often being unavailable or hard to reach during investigations, investigators’ attitudes that tend to be closed, difficulties in finding witnesses, and both internal and external barriers.
