Abstract
The crime of embezzlement in office is regulated by Article 374 of the Criminal Code (KUHP). This research is motivated by criminal case No. 221/Pid.B/2024/PN Pbr, involving defendant Hengki Ternando, the Operational Manager of DD Bar Pekanbaru. The defendant, along with witness Rahmi Pratiwi (separate file), was charged with embezzlement in office by manipulating fictitious overtime data to the detriment of the company. During the trial, the Panel of Judges found the defendant legally and convincingly guilty of the crime as stipulated in the primary and subsidiary charges. This research has two research questions: first, how to prove the crime of embezzlement in office by the Operational Manager of DD Bar Pekanbaru in Decision No. 221/Pid.B/2024/PN Pbr; and second, what legal considerations the Panel of Judges used in handing down the verdict in this case. The research method used was normative juridical, namely a legal research method by reviewing and analyzing documents in the form of decisions of the Pekanbaru District Court related to the case. The approach used was descriptive analytical, which aims to systematically describe the application of legal elements and the judge's considerations in deciding the case. The results of the study show that all elements in Article 374 of the Criminal Code in conjunction with Article 55 Paragraph (1) 1 of the Criminal Code have been fulfilled, based on evidence from the statements of 6 witnesses presented at the trial, and written evidence in the form of 2 sheets of employee absence recapitulation documents, 5 sheets of employee salary list documents, and 1 bracelet resulting from embezzlement. All of this evidence has fulfilled the requirements in Article 183 of the Criminal Procedure Code as a valid requirement for evidence in handling criminal acts. The legal considerations of the Panel of Judges in the decision were deemed appropriate using Negative Legal Theory and were in accordance with applicable legal provisions.
