Abstract
he use of parking services has become common in everyday life, especially in big cities that face increasingly difficult parking problems. Currently, many people rely on parking spaces provided by parking business actors to park their private vehicles. However, in some cases, there is often a loss of goods in parked vehicles, such as laptops, gadgets, or helmets which are the focus of the study. To find out the legal responsibility of business actors for the loss of goods while in the parking lot for parking service users. The problems in this study are: First, How is the responsibility of parking managers towards consumers who lose their helmets in the parking lot under the jurisdiction of the Air Dingin sub-district under civil law? Second, What are the obstacles to the implementation of parking managers towards consumers who lose their helmets in the parking lot under the jurisdiction of the Air Dingin sub-district under civil law? This study uses the Sociological Law research method (empirical) or observational research which is descriptive analysis is a study that collects data by going directly to the field. The location chosen to conduct the research is in the Air Dingin Village, Pekanbaru, with a focus on three locations, namely, Tanama Cafe, Malabar Cafe and Taman Aero Sport, The results of the research and discussion are as follows: The responsibility of parking management towards lost helmets in the parking area under the jurisdiction of Air Dingin Village in its implementation, viewed from the aspect of parking management under civil law, if a helmet is lost, the parking management must compensate for the losses arising from their mistakes in accordance with Article 1365 of the Civil Code. However, when viewed from the consumer aspect, illegal parking management tends to disclaim responsibility when loss or damage occurs to items entrusted or handed over by consumers, but when consumers want compensation, parking management refuses to compensate, hiding behind standard clauses. The obstacles in the responsibility of parking management in its implementation towards lost helmets in the parking area under the jurisdiction of Air Dingin Village, viewed from the aspect of parking management, include several obstacles, namely the lack of legal understanding among parking management, the number of parking management is not proportional to the area they oversee, and the compensation felt not commensurate with the income of parking management. When viewed from the consumer aspect, many people who feel disadvantaged due to lost helmets are reluctant to report or litigate to the court, citing the complicated and lengthy process as the reason.
