Abstract

Customary law is a set of rules derived from the traditions and practices of communities in specific regions, generally unwritten like statutory laws. Nevertheless, its validity is recognized and passed down orally across generations. The Indonesian government acknowledges the existence of customary law through various enacted regulations. The country’s rich diversity in ethnicities, customs, cultures, and languages contributes to the dynamics of its society, including the Batak Toba ethnic group, which adheres to its own customary legal system in many aspects of life, such as marriage, death rituals, and social relations. However, the challenges posed by cultural modernization in the era of globalization have led to a shift in traditional values within customary communities, including the Batak Toba. This study aims to examine the implications of marriages conducted without customary rituals within the Batak Toba community in Tapung Hulu District, Kampar Regency, Riau Province. It also seeks to identify the underlying factors that contribute to the practice of such marriages. The method used in this research is empirical legal research with a sociological approach and is descriptive-analytical in nature. Data collection was carried out through interviews, questionnaires, and direct observation of various customary community activities and traditional ceremonies conducted in the Tapung Hulu District. The findings reveal that non-customary marriages do occur among the Batak Toba community in Tapung Hulu. These practices are driven by factors such as economic constraints, cultural modernization, religious considerations, and a desire to avoid family conflict. Such marriages contradict the principles of Dalihan Natolu, and therefore, carry customary consequences in accordance with Patik Dohot Uhum as applied in the Tapung Hulu community.
