Abstract

The growth of digital platforms has opened up wide opportunities for content creators to collaborate and monetize their creations. However, in practice, many cases have occurred where content is reused by brands without consent, compensation, or even misused as fake testimonials. This phenomenon harms creators both morally and financially and raises questions about the effectiveness of copyright protection in Indonesia’s digital context. This study focuses on two main research questions. First, how effective is copyright protection for digital content creators in Indonesia in dealing with unauthorized use by brands. Second, what are the weaknesses in Indonesia’s copyright regulation that hinder creators from claiming their rights. The research uses a normative-juridical method with a statutory, case, and comparative approach. Data were collected from literature studies and real-life cases involving copyright infringement by brands. A comparative analysis was also conducted with copyright systems in countries such as the United States, European Union, Japan, and ASEAN nations with similar digital characteristics. The findings show that existing legal protection in Indonesia is not yet effective in addressing the rampant misuse of content by brands. Weak legal norms, procedural complexity, lack of accessible dispute resolution, and minimal platform accountability are key challenges. International practices such as the notice and takedown system, digital mediation, and blockchain-based verification offer potential solutions for Indonesia to improve its copyright regime in the digital era.
