Abstract

This study aims to determine the criminal liability of desertion by members of the Indonesian Air Force under Indonesian law and the considerations of judges in resolving desertion cases, as well as the efforts made to combat desertion by members of the Indonesian Air Force. The research questions are: First, how does the Military Prosecutor's Office I03 in Pekanbaru handle desertion cases? Second, what are the obstacles in handling desertion cases by the Military Prosecutor's Office I-03 in Pekanbaru? This research method uses sociological legal research on the effectiveness of law. This research is more focused on discussing how law applies in society, thereby showing the relationship between law and society, with the hope of revealing the effectiveness of law in society itself. The conclusions of this thesis are as follows: first, improving the quality of the Military Prosecutor's Office I-03 Pekanbaru through specialized training related to its duties, functions, and authority as a prosecutor in the military judicial system; second, enhancing the awareness of TNI personnel regarding military disciplinary law; Third, fostering collaboration with community leaders and traditional figures; Fourth, increasing the budget of Otmil I-03 Pekanbaru to focus on activities that support the performance of its duties, functions, and authority in the field of prosecutorial duties.
