Abstract

The crime of palm oil theft often occurs in the jurisdiction of the Kunto Darussalam Police, based on data obtained by the author from the criminal investigation unit from 2020 to 2024 there are various factors causing palm oil theft. The Kunto Darussalam Police seeks solutions by making efforts to overcome this by preventing and taking action against the perpetrators. Theft is regulated in Article 362 of the Criminal Code and is subject to a maximum fine of IDR 900,000 or a maximum imprisonment of 5 years. The main problem in this study is what are the factors causing the theft of oil palm fruit in the jurisdiction of the Kunto Darussalam Police, and what are the police's efforts in overcoming the theft of oil palm fruit in the jurisdiction of the Kunto Darussalam Police. The method in this research uses an empirical/sociological legal research type, namely analyzing data obtained from the field to find out a phenomenon by conducting surveys and interviews with respondents, while its nature is descriptive, namely providing an overview and explaining the research results. From the results of the research and discussion, it can be concluded that the factors causing the theft of oil palm fruit in the jurisdiction of the Kunto Darussalam Police are economic and poverty factors, gambling and drug addiction factors, work factors, weak law enforcement factors, and environmental factors. Police efforts to overcome this by carrying out non-penal preventive efforts, namely conducting patrols in areas prone to theft, appealing to palm oil platforms, forming neighborhood watch, and implementing legal socialization. Repressive efforts include taking action and undergoing the law enforcement process by the police.
