Abstract

he prohibition on Bagito marriage is a form of local wisdom that is still highly upheld by the Petalangan Malay community in Pangkalan Kuras District, Pelalawan Regency. Bagito refers to marriage between individuals or between tribes who are considered blood related in the view of Petalangan Malay customary law so that it violates ancestral customs and norms. This research aims to explore the history and background of Bagito, and the legal consequences faced by people who continue to violate Bagito's marriage. This research also explains the perspective of the indigenous community regarding the violation and how they preserve their traditional values. The method used is empirical legal research with a descriptive approach to describe the historical practice of Bagito's marriage and the legal consequences that would result if the marriage continues to be violated. The data collection techniques used were interviews with traditional leaders and direct observation of the research object. The research results show that there was a past event, the first because of a good relationship, and the second because of a bad relationship. What is meant by a good relationship is because of the value of reciprocation, and what is meant by a bad relationship is because of the emergence of fights between tribes, the legal consequences that arise if the community continues to carry out the Bagito marriage are being ostracized by the local community, the perpetrator of the marriage is not allowed to take part in events organized by the local traditional community, his existence is not considered at all, his opinion is not heard and, his title is not used. This encourages traditional parents to urge their children and nieces to know the history of Bagito.
