Abstract
Land holds strategic value in the economic, social, and cultural aspects of Indonesia, making it a frequent object of disputes. The litigation process for resolving land disputes is considered ineffective due to its lengthy duration, high costs, and the potential for prolonged conflict. Therefore, mediation is introduced as a faster, more affordable, and peaceful alternative dispute resolution method. This study aims to examine the implementation of land dispute resolution through mediation and to identify its inhibiting factors at the Land Office of Kampar Regency, as regulated by the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency No. 21 of 2020. The main issues addressed in this study are the implementation of mediation in resolving land disputes at the Land Office of Kampar Regency and the factors that hinder its success. This research uses an empirical legal method with a sociological approach and is descriptive-analytical in nature. Data were collected through interviews, observations, and documentation from the Head of the Dispute Control and Resolution Division, mediators, and disputing parties. The results of the study indicate that mediation has been implemented according to the procedures; however, its effectiveness remains low. Out of 60 cases mediated during 2023–2024, only 15 were successfully resolved. The main inhibiting factors include the limited number of certified mediators, low public legal awareness, and the lack of good faith from the disputing parties. Therefore, improving human resources within the National Land Agency, providing professional mediator training, and conducting legal outreach to the community are key to the successful implementation of mediation in resolving land disputes in Kampar Regency.
