Abstract

Customary law is an unwritten law that is a guideline for most Indonesian people and is maintained in everyday life both in cities and villages. As happens in society or some customs that someone who has the same ethnicity is prohibited from getting married, or one tribe with another tribe is prohibited from getting married. Such things are not allowed, even strictly prohibited, because if this happens according to local beliefs there will be a disaster that will befall the marriage participants, children, grandchildren, and will even have a bad impact on the village. The main problem in this study is what are the factors that cause inter-tribal marriages in the indigenous community in Pauhranap Village, Indragiri Hulu Regency and what sanctions are given to couples who marry inter-tribally in the indigenous community in Pauhranap Village, Indragiri Hulu Regency. The research method used in this study is empirical research with a descriptive approach. The population in this study includes traditional leaders, community figures from the Malay indigenous communities of Kampung Tonga, Melayu Koto Tuo, and Melayu Koto Baru, individuals involved in same-clan marriages, and the parents of those individuals. The sampling technique used is purposive sampling, and the data collection tool employed is interviews. From the results of the research conducted by the author, it is known that the Implementation of Marriages According to Malay customary law in Pauhranap Village, Indragiri Hulu Regency is still negotiating, if the community wants to carry out an inter-ethnic marriage, some of the Malay traditional community in Pauhranap Village still prohibits inter-ethnic marriages even though the implementing party still wants to carry it out, it will be negotiated and the punishment that will be given will be determined. That the factors causing intertribal marriage in the traditional community in Pauhranap Village, Indragiri Hulu Regency are due to limited choice of partners being the main reason, economic considerations and inheritance also encourage inter-tribal marriage, family pressure and tradition play an important role, social change and external influences also influence, and the tolerance mechanism in the custom itself provides space for inter-tribal marriage under certain conditions and the sanctions given to couples who carry out inter-tribal marriage in the traditional community in Pauhranap Village, Indragiri Hulu Regency, namely customary sanctions in the form of fines, customary sanctions in the form of compensation sanctions that can be carried out in the form of a number of goods, customary sanctions in the form of corporal punishment sanctions carried out by hitting the perpetrators of violators of customary law rules, customary sanctions in the form of social sanctions in the form of sanctions obtained directly from a group of people.
