Abstract

In Indonesia, the term online transportation services or application-based transportation services (online motorcycle taxis) has emerged. Subekti states that an agreement is an event where a person promises to another person or where two people promise each other to do something. The problem in this research is what kind of standardization is set between Go-Jek. Researchers want to know the standardization of tariffs applied to customers. Because researchers see that rates can vary for each customer even though the distance traveled is the same. The main problem in this study is what are the legal aspects of tariff fixing between PT Go-JEK in Pekanbaru City. What are the legal aspects of barriers to tariff setting between PT Go-Jek in Pekanbaru City. This study uses the legal research method observational research or survey where in this study collects information from respondents using a data collection tool in the form of interviews and the nature of this research is analytical descriptive, namely the research provides data as accurately as possible to describe how the Review of Legal Aspects of the Determination of Passenger Transportation Fares by PT Go-JEK Company in Pekanbaru City. The research results show that the legal aspect of PT Go-JEK's transportation tariff determination in Pekanbaru City is the partnership agreement between PT. GO-JEK Indonesia Medan Branch with GO-JEK drivers is a general form of a legal relationship between one party and another on the basis of a partnership agreement. The general provisions of the partnership agreement when viewed based on the Civil Code are regulated in Article 1338 jo. Article 1320. Meanwhile, for specific provisions, you can refer to the provisions regarding civil partnerships in Article 1618 of the Civil Code up to Article 1641, namely the legal relationship of the parties between one partner and another partner. Obstacles The legal aspect of PT Go-Jek's transportation tariff setting in Pekanbaru City is that for driver-partners the increase in tariffs has an impact through increasing competitiveness between the applicator management of other online motorcycle taxi companies.
