Abstract
Partnership is a formal, mutually beneficial business collaboration between small entrepreneurs and medium or large entrepreneurs to achieve a common goal based on a mutual principle agreement. Partnership is also a business strategy carried out by two or more parties within a certain period of time to achieve mutual benefits with the principle of mutual need and mutual growth. However, in the implementation of partnerships, contractors still do not demonstrate and provide legal protection because they do not have sufficient bargaining position in negotiating the contents of the partnership agreement and there is still ignorance regarding the type and significance of the existence of a partnership agreement, they usually only comply with the wishes or partnership agreement that offered by the provider. Like the partnership agreement entered into by the contractor with PTPN V Tandun District, namely the transportation of Fresh Fruit Bunches (FFB) by land. The problem of this research is How is the Partnership for Transporting Fresh Fruit Bunch (FFB) by PTPN V Tandun District?, and What is the Legal Protection for Contractors in the Partnership for Transporting Fresh Fruit Bunch (FFB) by PTPN V Tandun District?. The research method, namely sociological or empirical legal research, is research on legal identification and legal effectiveness in social dynamics. The nature of the research is descriptive The results of the research and discussion revealed that the partnership for transporting fresh fruit bunches by PTPN V Tandun District was based on a letter of agreement mutually agreed upon between the contractor and PTPN V, however, the partnership carried out still did not take into consideration the condition of the contractor as the party providing transportation services for fresh fruit bunches from field to the PKS, because the contractor, apart from carrying out transportation work, must also be responsible for the condition of the fresh fruit bunches so that they remain good and safe, including not being damaged, lost or mixed up. If the transporter cannot maintain this, the contractor is obliged to provide compensation in the form of an appropriate fine which must be received, and Legal Protection for Contractors in the Partnership for Transporting Fresh Fruit Bunches (FFB) by PTPN V Tandun District is not maximally given to the contractor because the agreed agreement has not yet been reached. can give contractors their rights as they should, especially in the case of applications for increases in transport wages, loading and unloading of fresh fruit bunches which are no longer in accordance with the existing agreement, there are still disputes regarding the condition of the fresh fruit bunches to be transported which are not the fault of the transporter and problems in determining and looking for loaders, whereas in terms of labor for loading, this must be based on approval from PTPN, and there is no increase in wages for transporting, loading and unloading fresh fruit bunches.
