Abstract

In the 1945 Constitution of the Republic of Indonesia, states that a good and healthy environment is a human right and constitutional for every Indonesian citizen. Therefore, the State/ the government and all stakeholders are obliged to do so environmental protection and management in implementation development. From a theoretical and juridical perspective, the environment has the right to get legal protection. Issuance of Law Number 32 of the Year 2009 concerning Environmental Protection and Management (PPLH) contains a philosophical value that views the right to the environment Good and healthy is the basic right of every citizen. It means the most important essence of the Management Protection Act Environment (UUPPLH) namely guarantees for environmental rights that good and healthy for everyone. Therefore, every company that wants to open a company must follow the regulations that have been made by the government (District/City, Province and Center). District and City Governments, could provide severe sanctions and fines for unscrupulous company owners who do not want to heed the applicable regional regulations, which have been made by DPRD Regency or City together with the Regional Head. Based on the author's observation, that the activities of PT. Surya Agrindo Mandiri (SAGM) has causing the environment to be damaged, thus causing income the life of the farming community is decreasing in production, and large it is possible that in 2021 the community will again experience crop failure, in because during the season farming can not be done because of abundant water flooding from the company, after the water has receded, the seeds and soil have already regenerated Agriculture is already experiencing drought. Based on the background of the problem that will be studied by the author in this thesis research, in the form of how the Juridical Environmental Impact Analysis of PT. SAGM on Community Agricultural Production in Batang Tuaka District Indragiri Hilir Regency Based on Law Number 32 of 2009 regarding Environmental Protection Management. And what about policy The local government of Indragiri Hilir district towards environmental damage caused by PT. SAGM. The research method in writing is the type of research used is empirical or sociological legal research, data and data sources in the form of Primary data obtained by research through respondents or samples, secondary data in the form of Law Number 32 of 2009 concerning Protection and Environmental Management and tertiary legal materials in the form of journals related to the problem under study.
