Abstract

The implementation of hire purchase agreement at Mandiri Utama Finance Pekanbaru 2021 is still subject to subpoenas of 14 people, due to defaults in the form of late monthly installment payments, overcredits delegated, months of arrears in payments, difficult to contact debtors and moving places. So the authors are interested in conducting research because there are still violations of previously agreed agreements that make the company have a fairly high risk. The main issues are how to settle defaults in a used car lease agreement at Mandiri Utama Finance Pekanbaru and what are the obstacles in settling defaults in a used car lease agreement at Mandiri Utama Finance Pekanbaru. This type of research is empirical research, namely by means of a survey or the author reviews directly to the research location with a data collection tool in the form of interviews. Its nature is analytical descriptive meaning that the research provides a clear, detailed and systematic description based on the fact that it occurs in accordance with the main research problems. The results of the study show that the Settlement of Defaults in the Used Car Rental Agreement at Mandiri Utama Finance Pekanbaru is carried out in a non-litigation manner, namely by means of deliberation/negotiation, where the creditor deliberates on the debtor's debt and provides an opportunity to make payments, if not responded to, a subpoena is given to the debtor, and if there is still no response, the company will confiscate the car, and Obstacles in Settlement of Default in the Used Car Rental Agreement at Mandiri Utama Finance Pekanbaru is a warning letter or subpoena given to the debtor that is not properly responded to, there is no good will from the debtor, the debtor difficult to contact, the car was transferred to another party without the knowledge of Mandiri Utama Finance.
