Abstract
Problems that arise in the implementation of e-commerce include the position of the principle of trust in buying and selling transactions through online shop media and the responsibility given by the seller if he defaults. To overcome this problem, several countries have made laws relating to e-commerce and e- contracts. In this study, the authors have a main problem, namely what is the position of the principle of trust in buying and selling transactions through online shop media in terms of Law Number 11 of 2008 concerning information and electronic transactions and what is the responsibility of business actors if they commit Default based on the principle of trust in selling transactions buy online As for the type of legal research method that researchers use in thesis research is the Nature of Research. This type of research is included in the normative legal research group. Meanwhile, seen from its nature, it is descriptive-analytic. The research results obtained are that consumers who were making transactions via the internet for the first time were reluctant to make purchases via the internet because of the high risks borne. Therefore, trust plays an important role in conducting transactions through electronic media. Trust is key. In the absence of trust from customers, buying and selling via the internet, the principle of trust comes from both parties themselves, mutually beneficial and not detrimental. The principle of trust includes people entering into agreements with other parties that increase trust between the two parties, because each of them fulfills his promise in buying and selling via the internet and Defaults that occur in online buying and selling transactions are generally carried out by business actors. In the event of such default, the business actor is obliged to compensate for the losses suffered by the consumer. If the business actor is not responsible for defaulting on online buying and selling transactions, consumers can take legal action in accordance with Articles 38 and 39 of the ITE Law regarding dispute resolution.
