Abstract

Basically humans are social creatures which means they need each other, humans have been created by God in pairs like Siti Hawa was sent down to earth for this to accompany Prophet Adam As. God created humans in pairs according to their needs. The purpose of marriage is also to provide materialized prosperity (mawaddah wa rahmah), to build a harmonious and prosperous family. But in reality, to create a happy family as originally dreamed of is not as easy as one might imagine, of course there are many trials, challenges and obstacles to being married. For some people, divorce is a way out of a problem that cannot be restored to harmony, this is confirmed in laws and government regulations article 39 of 1975, the reasons for divorce The problem is Do economic factors affect the high number of divorce cases at the Bangkinang Religious Court in 2022? And what are the efforts to prevent high divorce cases in the Bangkinang Religious Court? The purpose of this study is to determine the economic influence on the high number of divorce cases, and efforts to overcome the high divorce rate in the Bangkinang religious court. This type of research is empirical/sociological law, while in terms of its nature it is analytical descriptive. collecting data with surveys, data collection, field interviews and documentation. The population in this study were judges at the Bangkinang Religious Court, legal clerks, heads of the Bangkinang MUI and married couples who divorced due to economic factors, with a sample of 18 respondents. Taken through purposive sampling of marriages that have been retained for -5 years 0.05%, + 5 years 0.05% and + 10 years 0.05% direct data collection sample field surveys, interviews and then the results are managed qualitatively. The results of the study show that the high rate of divorce due to the economy is caused by husbands who are lazy to work, there is unemployment, there are frequent quarrels because of the economy, household needs are not fulfilled, leaving children and wives for years and not being supported, financial problems are not transparent, there is no harmony in the household and lack of responsibility towards the family. Efforts to prevent the high number of divorce cases that have been carried out by judges in summons for mediation by religious courts will carry out legal counseling related to marriage and the Chairman of the MUI in advising couples who want to get married, but the lack of knowledge about awareness of the rights and obligations of both parties, marriage is not because of the basis like and love each other, but mental, financial, faith and piety readiness must also be prepared to establish a household that is sakinah mawaddah warahmah.
