Abstract
Law and certainty are two things that cannot be separated. The law exists because of certainty, which makes the law more obedient. According to article 1313 of the Civil Code that the agreement is an act that binds one person to another, so that the purpose of the agreement is to become the basis for settlement if problems arise in the future so that the parties are protected, receive legal certainty, and justice. A written agreement is the basis for the parties to carry out a prosecution if one of the parties does not carry out what has been agreed upon in an agreement. However, in this case one of the parties to the cooperation agreement that was carried out at Berlian Kuok Sejahtera Housing died when the agreement was not completed from what was agreed upon, so the agreement could not be implemented. Regarding what happened, there are two problems in this research, as follows: First, how is the legal certainty of implementing the cooperation agreement between the developer and the land owner who has died at Berlian Kuok Sejahtera Housing, Kampar Regency. Second, what are the things that can be done so that the agreement can continue after the first party dies. This study uses the Sociological Legal research method (empirical) and is analytical descriptive in nature, namely research that collects data is carried out by going directly to the field. which is located in Berlian Kuok Sejahtera housing complex, Rimbo Panjang. The results of this study are that legal certainty regarding cooperation agreements that occur between developers and landowners who have died is the party that carries out the agreement to seek the heirs of the deceased landowners first and register their rights with the authorities. And the thing that must be done if the agreement continues is to register the agreement with the notary and replace these rights with the names of the heirs with the aim of a certificate of inheritance and then given a further and broader understanding by the notary.
