Abstract
In this study, more emphasis is placed on legal protection for consumers in the misuse of credit features (paylater) by third parties through the shopee marketplace where in fact there is still a lack of all efforts being made to ensure legal certainty to provide protection to consumers, especially the abuse of credit features (paylater) by third parties through the shopee marketplace which has been proven to this day still happening. The main problem in this research is how is the legal protection for consumers in the misuse of credit features (paylater) by third parties through the shopee marketplace, and what are the future ideas for legal protection against the practice of abusing credit features (paylater) by third parties through the shopee marketplace. The research conducted was normative legal research in this case by collecting legal materials consisting of primary legal materials, secondary legal materials and tertiary legal materials which the researchers then analyzed qualitatively. Based on the research results, it can be understood that legal protection for consumers in misuse of credit features (paylater) by third parties through the marketplace shopee is applied by paylater feature service providers where legal protection is oriented towards preventive efforts, such as working with certified institutions in storing and maintaining the security of service user data/information, implementing a layered security system, and providing education to service users. Meanwhile, the future idea of legal protection against the practice of abusing credit features (paylater) by third parties through the marketplace shopee has been regulated in the Financial Services Authority Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Borrowing and Borrowing Services. As well as consumer protection in article 18 of Law Number 8 of 1999 which explains what is prohibited in the contents of the standard agreement. As well as Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions related to consumer personal data.
