Abstract

In the delivery of goods carried out by business actors, namely PT. PMH (Horas Motor Transportation) and consumers as users of goods delivery services based on good faith in entering into agreements. However, the freight forwarding service company owned by the Expedition Company PT. PMH (Horas Motor Transportation), is not responsible to consumers in terms of shipping goods for loss or damage to these goods. Expedition Company PT. PMH (Horas Motor Transportation) is only responsible for the replacement of shipping costs by 10% and not for the value of lost or damaged goods, and of course the consumer suffers a loss, because it is not commensurate with the value of the lost or damaged goods, during delivery. Based on the background of the problem that the author described above, the author first determines how Legal Protection Against Damage to Goods in the Implementation of Transportation of Goods by Land at the Expedition Company PT. PMH (Horas Motor Transportation) in Pekanbaru City and How to Settle Compensation Cases Against Goods That Have Been Lost or Damaged in the Transportation Process. This writing, when viewed from the type of research, can be grouped into sociological legal research which is carried out by means of surveys, namely research directly to research locations using data collection tools in the form of interviews and questionnaires. Meanwhile, if seen from its nature, this writing is analytical descriptive, which means that the research is intended to provide a detailed, clear and systematic description of the main research issues. Legal Protection Against Damage to Goods in the Implementation of Transportation of Goods by Land at the Expedition Company PT. PMH (Horas Motor Transportation) in Pekanbaru City in the form of protection for collateral damage to consumer goods due to negligence from the Expeditionary party, in this case PT. PMH, by providing compensation of 10 times the shipping price, but this is not in accordance with the value of the losses suffered by consumers, when compared to the value of compensation provided by PT. PMH. Settlement of cases of compensation for goods that experience loss or damage in the transportation process is by way of compensating for losses suffered by consumers for goods that are damaged or lost by PT. PMH Pekanbaru branch as a business actor in terms of shipping goods belonging to consumers, but there is a tendency for consumers not to receive compensation provided by PT. PMH, and led to a settlement in court.
