Abstract

The life of indigenous peoples in West Sumatra is different from the tribes in Indonesia. The matrilineal system is used for inheritance distribution, but current developments cannot be denied that in the application of inheritance law there are those who apply customary law and Islamic inheritance law. As a consequence, there is a difference in understanding of all actions taken by the people in the Minang area which become habits (adat) which then contradict the Al'Qur'an. tanjung gadang Se. pinago West Payakumbuh? and (2) What is the process of inheritance according to Minangkabau Custom in Tanjung Gadang Village Sei. Pinago West Payakumbuh According to the Perspective of Islamic Law? The method used by the authors in this research is field research to collect primary data and secondary data which is used as material in writing this scientific research. the author directly conducts field research by conducting interviews to obtain the data needed in this research. the results of the research that the author carefully explained that the implementation of the division of assets between male heirs is small compared to the inheritance share of daughters, but for the smallest daughter it is distributed to her the house left by her parents, while the concept of Islamic relations is that the division is for sons double the share for boys double the share for girls. so the influence of Islamic Law is seen in the determination for girls. the inhibiting factor for the distribution of inheritance according to Islamic law is custom. Because this custom has long been used by the community from the past to regulate social relations which have become an obstacle in the distribution of inheritance according to Islamic law.
