Abstract
The development of e-commerce in the last few years can be said to be growing rapidly, one example is the online buying and selling site. In online buying and selling sites, there are many well-known online sales systems, one of which is the COD (Cash On Delivery) system, although it is one of the most popular systems, it does not rule out the emergence of various default cases in it. There were several cases that caused losses felt by the seller in a buying and selling transaction with a cash on delivery (COD) system. The main problem of this research is how is legal protection for business actors who are disadvantaged due to unilateral cancellation by consumers and what are the causes and impacts that occur due to unilateral cancellation by consumers in the cash on delivery system. The method used in this study is empirical legal research with a survey method, research carried out directly at the research location that has been determined with the aim of obtaining information and explanations that support the author's research, while the nature of this research is analytical descriptive, which the author clearly describes. and detailed problems to be studied by the author. The results of the author's research, the validity of an online sale and purchase agreement (e-commerce) using the cash on delivery (COD) system is considered valid if the four legal requirements of an agreement contained in article 1320 of the Civil Code are fulfilled. In the object studied by the author, there are losses suffered by business actors due to consumers who do not fulfill their obligations such as not taking ordered goods that have been delivered. Consumers who make unilateral cancellations at the online shop Nadia Pitaloka Olshop are given sanctions by business actors, namely being blacklisted or can no longer make transactions by COD at the online shop Nadia Pitaloka Olshop.
