Abstract
Mediation is a way of resolving disputes through the negotiation process to obtain agreement between the parties assisted by a mediator who is a neutral party. At the first trial attended by both parties, the examining judge for divorce cases requires the parties to mediate in accordance with the Supreme Court regulation Number 1 of 2016 concerning Mediation Procedures in Court The formulation of the problem in this study is: first, how to carry out mediation in resolving divorce cases at the Pasir Pengaraian Religious Court. Secondly, how effective is the mediation in the settlement of divorce cases in the Pasir Pengaraian Religious Court. The research method that the author uses is a type of empirical sociological research, (Observational Research) is by going down directly to get a number of data, while the nature of this research is descriptive analysis. The data and data sources of the authors use secondary data, for data collection techniques the authors use interview techniques, questionnaires, documentation. In analyzing the data, the author uses the quality method, namely analysis that connects with laws and regulations. Meanwhile, the method of drawing conclusions that the author uses is the inductive method, which is to draw conclusions from things that are specific to the general. From the results of the research that the author can find, namely as follows: First, the implementation of mediation in the Pasir Pengaraian Religious Court is carried out in accordance with Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Courts, but the parties who have no good faith in the mediation process. Second, the effectiveness of mediation in divorce cases in the Pasir Pengaraian Religious Court is less effective, judging from the low success rate of mediation in 2020-2021 due to the strong desire of the parties to divorce, causing the mediation to be unsuccessful.
