Abstract

The rental of heavy equipment at PT Ivana Nusantara Pekanbaru is based on an agreement. The lease agreement for heavy equipment made by the lessee has problems because the lessee does not carry out the agreement by not making payments on time, and does not accept any reduction in working hours even though working hours are not in accordance with the agreement with the owner of the heavy equipment due to weather disturbances rain that cannot be conditioned to continue work. Where the tenant asks the owner not to cut the working hours that have been promised, namely 200 hours. But based on the agreement the owner did not agree because it was guided by the agreement that had been agreed The main problem of the research is How is the default in the heavy equipment rental agreement between the tenant and PT Ivana Nusantara Pekanbaru, and what are the obstacles to settlement of default in the heavy equipment rental agreement between the lessee and PT Ivana Nusantara Pekanbaru. The research method is empirical or sociological legal research. while its nature is descriptive, namely where the author describes in detail and clearly the problem to be studied. The results of the study show that default in the heavy equipment rental agreement between tenants and PT Ivana Nusantara Pekanbaru is due to negligence, such as from the lessee who delays or does not pay the rent on time for excess time or overtime work, as well as from the party who rents the equipment. heavy equipment that does not accept requests from the lessee to cut working hours even though working hours are not in accordance with the agreement with the owner of the heavy equipment due to rain weather disturbances that cannot be conditioned to continue work, and Obstacles in Settlement of Default in the Heavy Equipment Rental Agreement Between The tenant with PT Ivana Nusantara Pekanbaru is a lack of awareness and responsibility on the part of the lessee in carrying out all the provisions in accordance with the agreement and the owner of the heavy equipment does not tolerate the lessee even though it is clear that there is a situation in the field that cannot be forced to use the heavy equipment but the owner persisted not to extend the processing time.
