Abstract
The widespread distribution of food and beverage products that do not have a distribution permit in accordance with the provisions of the applicable laws and regulations has sparked concern from all walks of life. The standards for proper consumption of various products on the market with distribution permits are regulated in Law Number 18 of 2012 concerning Food. Although consumer protection for food and beverages without a distribution permit (TIE) is not clearly regulated in Law Number 8 of 1999 concerning Consumer Protection, it can be said that the actions of business actors distributing food without a distribution permit violate the provisions of UUPK. These actions cause harm to consumers, so that business actors must be held accountable for their actions. The purpose of this study is to determine the form of legal protection for consumers of food and beverages without distribution permits (TIE) and to determine the factors constraining legal protection for consumers of food and beverages without distribution permits (TIE). This research is included in empirical or sociological legal research which is descriptive in nature, namely the author describes clearly and in detail the problems to be studied. The results of the research show that legal protection for consumers is in fact various regulations that have been issued by the government as an effort to protect consumers from food and drink without distribution permits, such as the UUPK, the Food Law, and the Health Law. However, these regulations have not been accompanied by maximum enforcement by the authorized state apparatus. Obstacles to legal protection for consumers of food and beverages without distribution permits (TIE) are the government, in this case the Balai Besar POM in Pekanbaru, in carrying out the task of supervising TIE food and beverages, they still encounter conditions in the field, namely resistance from business actors; high demand for TIE food products so that TIE products are still circulating (law of supply and demand); Purchasing through sales so the source of the purchase cannot be identified. There are many rat ports which are the entrances for TIE food.
