Abstract

Cooperation carried out by the pharmacy department with drug distributors can be categorized as an economic activity that has a legal factor in the scope of the agreement. Based on the results of the survey that the researcher has conducted, in this study the researcher will discuss the cooperation agreement. During the cooperation agreement there were still many persons who were not inconsistent with the cooperation agreement that had been mutually agreed upon and there were also parties who did not carry out their duties and caused trouble for other parties, such as the problems that occur in most pharmacies, they were often late in making payments. As for this research, there are main issues that will be discussed, namely, the Implementation of Agreements Between Pharmacies and Drug Distributors Regarding the Drug Payment System at Pharmacies in Pekanbaru in 2021 and secondly the Legal Consequences of a Cooperation Agreement Regarding the Drug Payment System at Pharmacies in Pekanbaru 2021. And as for the goals of this research is the same as the formulation of the main problem, namely to find out the results of the problem formulation made by the researcher. This legal research includes the type of Sociological or Empirical research (Observational Research). This type of research method is intended to solve problems that exist at the moment by collecting data and compiling or classifying it and then analyzing and seeing a legal reality in society to then obtain a result. The research results that the author obtained are: Implementation of agreements between pharmacies and drug distributors regarding the drug payment system at pharmacies in Pekanbaru in 2021, several pharmacies have been running according to the rules and agreements, and legal consequences arising from the Cooperation agreement regarding the drug payment system related to the drug payment system between pharmacies and drug distributors in 2021, juridically every agreement made legally will be binding as law for those who make it and if the contents of the agreement are not fulfilled then according to Article 1243 of the Criminal Code this includes default or can be interpreted as an act broken promise, in this case the party committing the default must bear the consequences of the opponent's demands in the form of cancellation of the agreement, cancellation of the agreement accompanied by demands for compensation, fulfillment of the contract where the creditor only asks for the fulfillment of the achievements of the debtor, fulfillment of the contract with a tun compensation.
