Abstract

The agreement between the parties means that every contract that has been made and mutually agreed upon by the parties must be carried out in good faith. However, as time goes by there are several cases where one of the parties bound by the contract defaults and/or violates good faith, where one party does not carry out its obligations as mutually agreed upon. Like distributor/dialer agents, there are still those who are late in paying off payments or there are even distributor/dialer agents who don't pay distributors. So the distributor experiences arrears in capital which will be transferred to the producer. The principle of good faith in a cooperation agreement means that the parties to the agreement must act appropriately and not conflict with the norms of decency and propriety. The aim is to prevent inappropriate and arbitrary actions by either party. However, this is not the case with the spare parts distributor cooperation agreement in Pekanbaru City because it is still alleged that there is a conflict with the agreed agreement. The problem of this research is how to apply the principle of good faith in cooperation agreements for two-wheeled vehicle spare part distributors and what are the obstacles to implementing the principle of good faith in cooperation agreements for two-wheeled vehicle spare part distributors. The research method, namely sociological or empirical legal research, is research on legal identification and legal effectiveness in social dynamics, and the nature of the research is descriptive The conclusion states that the implementation of the principle of good faith in the cooperation agreement for distributors of two-wheeled vehicle spare parts has not gone well even though it has been based on the legal provisions in the cooperation agreement which has become an agreement, because in the implementation of this two-wheeled vehicle spearpart distribution cooperation there have been problems, especially in terms of actions Default in terms of payment for products due to defects in spear parts sent which cannot be traded and lack of good faith to settle through deliberation even though this has been agreed upon but is directed towards civil disputes become a criminal report, and the obstacle in implementing the Principle of Good Faith in the Cooperation Agreement for Distributors of Two-Wheeled Spare Parts is due to the failure to provide transparency regarding the goods to be distributed while the goods are not in good condition so they cannot be sold and even though they can be sold However, it no longer corresponds to the price set, so this causes delays in paying off the payment for the goods sent
