Abstract

Domestic violence is any act in the form of threats, coercion, harassment and physical, sexual and psychological violence between two people who are bound by marriage or other family members. Domestic violence does not only involve violence committed by husbands, wives, and/or people who are only related by blood but also someone who works as a domestic worker who remains in the household. The aim of this research is to find out how penal mediation is implemented as an effort to realize restorative justice in resolving criminal acts of domestic violence and to find out what are the obstacles in implementing penal mediation as an effort to realize restorative justice in resolving criminal acts of domestic violence. To carry out this research, the type of research that the author uses is observational research, namely legal research by conducting direct surveys in the field (research objects) to obtain primary data. Primary data is the main data obtained by researchers through respondents or samples. Based on the results of research on the implementation of penal mediation as an effort to realize Restorative Justice in resolving criminal acts of domestic violence, the Bengkalis resort police implement the values of Restorative Justice through penal mediation by mediating between the perpetrator and the victim by means of meetings, negotiations, discussions. , with the victim, so that the settlement can fulfill a sense of justice for both the victim and the perpetrator which has an impact on recovery and compensation for the victim's condition. Meanwhile, the obstacles are the lack of institutionalization of the resolution process through mediation among law enforcers and the community, as well as the lack of public distrust towards law enforcers.
