Abstract
Franchising is a special right owned by an individual or business entity to a business system with business characteristics in order to market goods and or services that have been proven successful and can be utilized and or used by other parties based on a franchise agreement. The emergence and development of this franchise business will certainly bring new problems to the world of law, a good and adequate legal system is needed to regulate this business in a country, in order to create certainty for franchisors. The development of the franchise has brought new problems to the realm of law in Indonesia. This is proven by the many problems that arise in connection with this franchise agreement. This is what makes the writer interested and examines this matter in a scientific work with the formulation of the problem, namely: How is the implementation of the Thai tea Dumdum franchise agreement in Tanjungpinang City Based on Government Regulation Number 42 of 2007 concerning Franchising? and how to solve problems that arise in the thai tea franchise agreement? The research that the authors use in this study is an analytical descriptive legal research method which provides a real picture or a clear picture (facts) of the problems being studied by the researcher. In this study, researchers used data derived from primary and secondary data with interviews and documentation as well as scientific studies as the basis for data collection. From the results of this study it is known that the implementation of the agreement between the two parties between the Franchisor and the Franchisee is not running according to the agreement and agreement that has been signed, in which there are still violations between the two. Delays in the arrival of basic commodities and several main tools that have not been delivered by the franchisor, so that the franchiser has to wait longer to close the store and suffer losses. The efforts made by the franchisor are still not optimal so that many violations occur.
