Abstract
The people of Indonesia are endowed by God Almighty with wealth in the form of abundant natural resources, both on land, water, and in the air, which are the fundamental capital of national development in all spheres. So that legal certainty is required in its use, so that in the provisions of Article 33 paragraph (1) of Law No. 5 of 1990 on the Conservation of Biological Resources and their Ecosystems or abbreviated as UUKSDA it is expressly stated that “Everyone is prohibited from carrying out activities that may result in changes to the integrity of the core of the national park. The socialization of the ban on palm cultivation followed by the Tessa Nilo National Park Hall together with the local police seemed abstract and ineffective as more and more land clearing for the oil palm plants was becoming more and more widespread. And this, always a question related to the actions taken by law enforcement officers who do not stop the encroachment of conservation areas in Riau Province. The lazy formula of this study is How is Article 33 paragraph 1 of Law No. 5 of 1990 applied in the area of Tesso Nilo National Park? , What Factors Prevent the Application of Article 33 Paragraph 1 of Law No. 5 of 1990 In the Tesso Nilo National Park Area? This type of research is empirical-sociological legal research, that is, research that examines how positive law applies or also called legal effectiveness. The result of this study is that the application of Article 33 paragraph 1 of Law No. 5 of 1990 In the Tesso Nilo National Park Area has not been maximized. This is not the case because the regulation of the protection of biodiversity in general was initially seen in Law No. 5 of 1967 on the Basic Provisions of Forestry, in the legislation there is an awareness of the importance of the protection of natural resources in which there is biodiversity, factors that are obstacles in the application of Article 33 Paragraph 1 of Law Number 5 1990 In the area of Tesso Nilo National Park there was a widespread encroachment of forests by the people. One of the obstacles in implementing the aforementioned article 33 is forest encroachment. The encroachment and occupation of forest areas land carried out by the community.
