Abstract

The demonstration of thousands of village heads in front of the MPR/DPR Building demanded the extension of the previous six-year term to nine years and asked the DPR-RI to revise the term of office. The formulation of norms governing the term of office of village heads is regulated in Article 39 of Law Number 6 of 2014 concerning Villages. The village head's desire to extend the term of office is unusual in the rule of law and democracy system. The extension of the term of office of the village head will make the climate of democracy and village government unhealthy and can even nourish the oligarchy in the village. In addition, the extension of the term of office of the village head can raise the risk of abuse of authority and power, resulting in the emergence of dynasties and nepotism in government, dynastic phenomena that also appear in the election of village heads. In the Thesis entitled "Juridical Review of the Plan to Extend the Term of Office of Village Heads for 9 Years in Relation to Law Number 6 of 2014 concerning Villages", the focus of the study is to analyze the Extension of the Term of Office of Village Heads to 9 Years in connection with Law Number 6 of 2014 concerning Villages and to analyze the Proposal to Extend the Term of Office of Village Heads from the Perspective of Constitutionalism\. The method used to answer the problems mentioned above is to use a combined research method, namely the normative legal research method, namely by conducting a literature study. \Based on the results of research, it is known that such a long and absolute power has the potential to corrupt. The extension of the term of office of the village head can cause the risk of abuse of authority, the risk of abuse of office, the occurrence of social jealousy in the midst of the community, the emergence of leadership dynasties so that healthy regeneration does not occur, raises the risk of misuse of village funds, causes nepotism in the structure of filling positions in the village government and so on. The perspective of Constitutionalism in its development of the modern state constitution must be constitutionalism. This means that the constitution must limit power, this is done to avoid acts of misappropriation due to not being limited in power
